Two downtown voters are suing to disqualify David S.Y. Chang, the Republican candidate for the state House’s 28th District, from the upcoming general election.

Lynne Matusow and Anthony Y. Chang (no relation) filed a lawsuit in state court today against David Chang and state Chief Election Officer Scott T. Nago.

The lawsuit claims David Chang is not eligible to run for the seat because he did not reside in the district when he submitted his nomination papers in July.

The state Constitution requires candidates to be qualified voters of the district in which they seek election prior to filing nomination papers and thereafter.

Matusow and Anthony Chang had previously challenged David Chang’s nomination, but Nago rejected the challenge, saying David Chang was a qualified voter for the district when he filed his nomination papers.

Chang listed a unit in 1188 Bishop St. as his residence on his nomination papers and his voting record. The building at that address is a nonresidential commercial and office condominium.

Nago said that Chang submitted an affidavit on the same date he submitted his nomination papers, changing his address to 1088 Bishop St.

Chang ran unopposed in this month’s Republican primary.

Incumbent Karl Rhoads ran unopposed in the Democratic primary.
