Attorney general orders Trump Foundation to stop fundraising in N.Y.

ALBANY, N.Y. » The New York attorney general’s office has ordered Donald Trump’s charitable foundation to immediately stop fundraising in the state, saying it isn’t registered to do so.

The head of the attorney general’s Charities Bureau, James Sheehan, wrote in a letter to a lawyer for the Republican presidential nominee’s foundation that the failure to stop immediately and answer demands for all delinquent financial reports within 15 days “shall be deemed a continuing fraud upon the people of the state of New York.” The letter was dated and sent Friday.

Democratic Attorney General Eric Schneiderman has been investigating the Donald J. Trump Foundation following Washington Post reports that foundation spending personally benefited the presidential candidate. The newspaper, citing tax records, also reported that the charity has been funded entirely from outside donations since 2008, when the candidate made his last contribution to it.

The attorney general’s office said the Trump Foundation had a registration for an organization with assets in New York but the law requires a different registration for those that solicit more than $25,000 a year from the public.

“Based on information received by the Charities Bureau to date, the Trump Foundation was engaged in solicitation or fundraising activities in New York State in 2016 and was not registered with the Charities Bureau pursuant to Article 7-A, and thus was not permitted to engage in such activity during this period,” Sheehan wrote.

The Trump campaign has said the foundation intends to cooperate with the investigation. The campaign previously called Schneiderman “a partisan hack who has turned a blind eye to the Clinton Foundation for years and has endorsed Hillary Clinton for president.”

“While we remain very concerned about the political motives behind A.G. Schneiderman’s investigation, the Trump Foundation nevertheless intends to cooperate fully with the investigation,” Trump campaign spokeswoman Hope Hicks said.

In September interviews, Schneiderman told Politico that in June his office had communicated with foundation lawyers about what appeared to be an unlawful campaign contribution and didn’t make a public fuss about it and hold a press conference.

“If I’m a traffic cop, but I’m a Democrat, and (Trump) speeds by me, I have to give him a ticket. It’s that simple. Charities have to follow the rules,” Schneiderman told “CBS This Morning.”

His spokesman Eric Soufer said, “The attorney general’s office is the sole regulator of charities in New York State, and when evidence of clear misconduct is brought to our attention, we take action.”

    Yet another example of Mr. Trump’s lawlessness. So of course, when Mr. Trump is caught violating the law, he blames the Attorney General and not himself. He is pathologically unable to admit a mistake or accept responsibility for any wrongdoing. It’s always someone else’s fault.

    This is no big deal, as klastri seems to think it is. All Trump has to do is get a new registration that permits the Foundation to solicit more than $25,000 a year in New York.

      It IS a big deal. If people on the foundation didn’t know about needing to register, then their ignorance about requirements of the law is of concern. If they did know and still did not register, then they ignored the legal requirements which is also of concern. This is no mom-and-pop organization. When raising hundreds of thousands of dollars, a foundation should know exactly what it is doing. It is already October of 2016. The foundation has been operating illegally for over nine months. Yes,Ronin, this is a very big deal.

      Of course it’s a big deal. Because it will further expose Mr. Trump’s illegal use of charitable funds to pay fines and law suit proceeds, and to buy gifts for himself. It’s a big deal for anyone who understands law that pertains to charitable foundations.

      He is almost certainly going to be forced to pay that back, as well as pay a fine to the IRS. He’s had to do that before following his illegal gift to the Florida Attorney General from the foundation.

      He doesn’t care at all about the law. Not one whit.

        Klastri, the requirement to register to solicit donations of more that $25,000 in New York is contained in a New York law. What does the IRS have to do with violations of New York laws?

      IRT Ronin006, the Trump Foundation will prepare an application, submit to the NY Office, and have it approved as the NY AG’s office says is required. Issue goes away.

        It doesn’t go away because one of the requirements once you’ve registered is that the foundation has to undergo an annual independent audit. This is the reason he never got registered. He doesn’t want to be audited by an independent auditor. It would show how many illegal things he is doing….

    An examination of the Clinton Foundation’s donations from media companies by Politico revealed that conservative media donated millions to the charity. Newsmax Media was listed as a donor in the 1,000,000-$5,000,000 range. News Corporation Foundation, the arm of Fox News’s former parent company, has donated $500,000-$1,000,000. Conservative billionaire and Clinton political enemy, Richard Mellon-Scaife has donated $250,000-$500,000.

    Trump won’t register his foundation because if he does the foundation would have to undergo an annual independent audit which would expose his many illegal activities with his foundation. This is on purpose. The same guy the oversees Eric Trumps foundation is the same guy that over sees the Trump Foundation and guess what, Eric Trump’s foundation is registered. Hmmmm…I wonder why he didn’t register Donald trumps foundation?…

    It turns out Mr. “Taco Trucks On Every Corner” Latinos for Trump founder Marco Gutierrez is also a serial bankruptcy filer. According to court documents from 2014, Gutierrez has filed bankrutpcy at least 14 times. A potential creditor and former friend explained how they used bankruptcy filings as sort of a pyramid scheme:

    During the time I was working with [Debtors] they explained to me how they were using the bankruptcy court to prevent foreclosure on their home and to prevent other collection efforts, since they had no money. Mrs. Gutierrez explained to us that the way they were preventing a foreclosure was by filing for bankruptcy and then not following up on a legal requirement and the case would be dismissed. She explained to us that sometimes there was a three month period between the filing and the dismissal and that interfered with the foreclosure.

    This is the man who created the “Latinos for Trump” group. He aspires to be Donald Trump, clearly. Serial bankruptcies, scamming immigrants, trying to use a federal program to help people save their homes as a personal piggy bank. These are characteristics of the man he supports so fervently.
