Child rapist gets probation

  Craig T. Kojima / ckojima@staradvertiser.com With his lawyer Michael Green, Thomas Kamaka Jr., right, pleaded no contest Monday to charges of raping a minor.

A state judge sentenced this morning a man accused of raping an underage girl and beating up the girl's brother who tried to intervene to five years of probation.

Thomas Kamaka Jr., 43, pleaded no contest to four counts of second-degree sexual assault in February in a plea deal that allowed him to avoid any time behind bars.

Circuit Judge Karen Ahn said she was surprised with the deal but reluctantly went along with it after talking to the prosecutor and asking her to justify the deal.

Deputy City Prosecutor Lisa Demello said the plea deal means the defendant will have to register as a convicted sex offender for the rest of his life and spared the victim, who is younger than 14 years old, from having to see Kamaka again and testify against him in court.

They had to take the next best option and plea on the deal. Sad! but it is our justice system and that is how it works. The judge knew it and the prosecutors knew it. There is probably some truth to the trauma issue for a young victim but the prosecutor does not have to get their permission for a plea bargain. They may ask or inform, but certainly do not need permission from the victim or the family to proceed or not.

I believe right now its only a couple of years. So if he's been waiting for trial for at least 2 years, then its time served and he can walk. But if its 10-20 years MINIMUM, that give them a lot of time to be in jail to be treated as they have treated others. ;) This way lawyers cannot whittle down the punishment to nothing and the criminals will get what they deserve up the wazoo (yes, pun seriously intended!).
