Hawaii enacts 4 new laws to curb cybercrimes

Four new Hawaii laws are aimed at curbing cybercrimes.

Gov. Neil Abercrombie recently signed bills to combat cyberbullying, to prohibit adults from soliciting minors to electronically transmit nude images of minors and to allow out-of-state records to be subpoenaed in criminal cases. 

The cyberbullying law recognizes that using a computer to harass, annoy or alarm a victim justifies an additional penalty for the existing offense of using a computer in the commission of a separate crime.

A “sexting” law creates new offenses for adults who intentionally solicit a minor to electronically transmit nude photos or video of minors. It also prohibits anyone from knowingly possessing a nude image transmitted by a minor. 

Prosecutors can now obtain evidence held by mainland corporations, such as cell phone records.

This is a dumb law. The Internet is NOT a place for Law Agencies to criminalize. Electronics are anonymous signals that cannot be and should NOT be made into a crime. To give Govt. a foothold into electronic signals is asking for trouble and an additional method to fill prison spaces, further draining the economy. The electronic world will go in many directions in the future and this Law will ride along with it, criminalizing things it never imagined it would go. It takes away free speech and expression and will make it a crime to do so. Not only takes it away but inhibits it and stifles creativity, not to mention Privacy. Bad move, bad Law. Pity.

The State did this in 2007-2008, saying at the time it seemd like a safe bet. The Hawaii Department of Budget and Finance needs a re-education on economics. High yield = High Risk We got burned by the big banks again, after we bailed them out. How about passing some laws that really matter to the wallets of people. Stop distracting us with all these stupid laws.
