Federal agent denied murder case transfer to U.S. District Court

LAST UPDATED: 02:33 a.m. HST, Aug 08, 2012

State Department Special Agent Christopher Deedy has lost his bid to transfer his murder case to federal court.

U.S. District Judge Leslie Kobayashi denied his request for permission to seek the transfer of the case from state Circuit Court to the federal courts.

Kobayashi issued the order Tuesday after she said she carefully reviewed the defense request as well as the city prosecutors’ opposition.

Deedy, 28, is charged with murder in the shooting of Kollin Elderts, 23, early Nov. 5 at the McDonald’s Waikiki restaurant on Kuhio Avenue.

Deedy missed the federal deadline of 30 days after his arraignment to ask for the transfer, but his lawyer Brook Hart argued that because of later developments, he had good reason to ask for permission to file the transfer request after the deadline. City prosecutors opposed granting permission.

The move paves the way for the resumption of the state court proceedings.

His trial was scheduled for September, but will likely be postponed because of pending pretrial motions.

Oh yes, and Elderts was such a fine, upstanding citizen and probably a likely MENSA candidate, too, no doubt!

And if he weren't a fine upstanding MENSA member, that would make his murder okay? Is that what you're implying?

LOL, he should be thankful. Now he gets a real chance for freedom facing the city prosecutors office. If he's lucky, he'll get chief donkey Kaneshiro himself. He just has to hope he doesn't get Arrisgado...

A silver lining. Hart is a master at voir dire, something he would not be able to do in federal court. He'll have the jury saying not guilty before the evidence comes in.

Yup, see an appeal strategy in there. On a separate issue, Judge Ahn is going to be MORE p!ssed.

This is a guy who seemed use his position and thought he could get a way with it. He is suppose to be an agent. I don't care if a local guy gave him a hard time in his opinion. he should have handles it in a professional way. He acted like a guy with too much testosterone instead of level headed. Sounds like he wanted to be an agent so he could carry a gun and was anxious to shot someone. Just my opinion. I don't know all the facts.
