Defendant in freeway shooting case won't take witness stand

Toby Stangel, accused of a freeway shooting spree that killed a woman and wounded two others, will not take the witness stand in his own defense.

At the close of the state’s case against him this afternoon, Stangel told state Circuit Judge Glenn Kim that he will not testify. He also chose not to present to the jurors any other witnesses in his defense.

Stangel, 30, is facing a possible prison term of life without parole for allegedly shooting at two police officers and life with parole for allegedly shooting at five motorists on Waialae Avenue and the H-1 freeway, killing one of them and wounding two, during a 17-minute crime spree on June 3, 2012. He is on trial for second-degree murder, first- and second-degree attempted murder, firearm charges and possession of drugs and drug paraphernalia.

The jurors will hear closing arguments Tuesday afternoon.

Of course he won't take the stand...he doesn't want to be cross examined by the prosecutor since he has no viable defense or reason for his unprovoked shooting of all those victims. Juries tend to convict defendants who refuse to testify in their own behalf.

There is no excuse for what he did but under our laws, defendants aren't required to take the stand. He doesn't need to take the stand because he was caught red handed along with witnesses that easily identified him. So, is the hate because he committed the crime or is there other reasons. Is it because his father is a Minister? Surly that couldn't be the reason. After all, many Ministers or their family members have committed murder before. Catholic Priests have been molesting little boys so much that we have lost count, yet when you talk to Catholics, they don't want to talk about it. I just wonder about all the hate.

If you are trying to make a case for commenters showing religious persecution because Stangel's dad is a minister, I don't see it. I think killing a mother of ten children as being horrible enough, to say nothing of wounding two more people, and shooting at three more (including two police officers). What axe are you grinding here?
