Prosecutors have charged the motorcyclist who allegedly fired a handgun, shooting at the ground, Wednesday afternoon after being confronted by a motorist's family member in Waimanalo.

Brandon Abiva, 21, was charged today with first-degree terroristic threatening and first-degree reckless endangering. His bail was set at $35,000.

The Ewa Beach man was one of three motorcyclists who had been involved in a traffic incident on the H-3 freeway Wednesday afternoon that prompted a woman motorist to call family members, who followed the motorcyclists to Waimanalo.

In Waimanalo, one of the woman's relatives, a 33-year-old man, got involved in a verbal argument on the street with Abiva, police said. The motorcyclist allegedly pulled a handgun out of his backpack and threatened to shoot the man.

The relative then got into the car driven by a 42-year-old man. The motorcyclist pursued the car, fired several shots into the ground, and then fled, police said.

Shortly after the shots were fired, at about 4 p.m., police spotted Abiva on Kalanianaole Highway, near Keolu Drive, as he was stopped in traffic. Abiva tried to maneuver his motorcycle around police cars, allegedly damaging two of them. Police apprehended him as he attempted to flee the scene on foot.

The other two motorcyclists fled the scene, despite a police helicopter and ground crews searching the area.

Two years ago, Abiva was convicted of second-degree robbery, a Class B felony. He was sentenced to five years' probation and a one-year suspended sentence.

So he's a convicted felon, on probation, with a concealed weapon, who tried to evade police. The judge is going to at least give him a tongue-lashing and at least another five years probation.

And how did this criminal get only probation for second-degree robbery, a class B felony? It is amazing that this guy got off easy on such a serious charge. We catch these guys and what do the judges do? They basically let them go with a slap on the wrist. These type of crimes should automatically mean jail time.

A felon with a gun committing another crime = have fun in OCCC. Probably not as long as what he deserves knowing the liberal judges in this state.

Sounds like drugs, or testosterone poisoning, or both. I just hope they can keep him off the streets for a good long time, because otherwise it looks like more felonies are in his future.
