AG: Geothermal revenue must go to Native Hawaiians

Hawaii's attorney general says royalties from geothermal resource development on Hawaiian home lands must be used to benefit Native Hawaiians.

State Attorney General David Louie announced his formal opinion on the issue Tuesday, saying 100 percent of the royalties must go to Native Hawaiians.

He says he came to the conclusion after a comprehensive legal analysis by deputy attorney generals in his office.

His opinion also concludes that the Department of Hawaiian Home Lands is the only state entity authorized to manage geothermal resources on Hawaiian home lands.

Louie says he hopes his formal opinion will help the lawmakers and the community understand the department's rights to the economic benefits of geothermal resource development on home lands.

The law that conditioned Hawaii's admission as a state of the Union specifically provides that “all proceeds and income from the ‘available lands’, as defined by the [HHCA], shall be used only in carrying out the provisions of [the HHCA].”

The lands were owned by the royalty and lands were delegated down to chieftains who managed the people. When the chieftains died, land was passed to another person or down the mother's line, not the father's line.

Funny how you want to lump all Hawaiians together, The Hawaiians protested . . . Even if they did, that does not justify giving the Department of Hawaiian Home Lands the proceeds from geothermal development on DHHL lands. Even if all Hawaiians protested geothermal energy, if someone is going to go on those lands and develop it against their will, Hawaiians should still get 100% of the proceeds.
