Jury in Deedy murder trial reconvenes

By Star-Advertiser staff

LAST UPDATED: 04:12 p.m. HST, Aug 21, 2013

A Circuit Court jury resumed deliberations this morning on the murder charge against State Department special agent Christopher Deedy.

The jury deliberated Thursday afternoon and two full days Monday and Tuesday without reaching a unanimous verdict.

Deedy, 29, is charged with murdering Kollin Elderts, 23, of Kailua, in a shooting early Nov. 5, 2011 at the McDonald’s Kuhio Avenue restaurant in Waikiki.

The panel’s options are either acquitting or convicting Deedy on the charge that carries a life term with parole.

The jury does not have the option of returning a conviction on a lesser offense of manslaughter.

The stupid decision by the District Attorney to go for broke.(That is to go for "murder" instead of "man slaughter") is a big gamble. The evidence doesn't seem to support it. Manslaughter would have probably been a shoe in. Murder, since Deedy was assaulted first, doesn't seem to be the situation.

You are mistaken, Deedy made the firsst move to kick. But it is irregardless of who did this or that first. It is Murder because there is only one outcome. The Person with the Gun will win and other will lose. Elderts had NO CHANCE of winning no matter the circumstances. The governing point here is, did the event "come" to the Person with the Gun, or did the Person with the Gun "go" to the event? In this case Deedy went to the event that escalated. Compose different scenarios, who struck first, who was on top, on the bottom, who said this or that, Elderts would ALWAYS come out the loser. When there is ONLY one outcome, it is Murder. Consider, what if Elderts were being beaten to death, does he have a remedy? No. Only beaten to death. Deedy only has a remedy, shoot him. Even "if" Deedy was winning, he could still shoot Elderts and say that he was reaching for his Gun. It is a complete lose/die for Elderts and a Win/shoot for Deedy. This is Murder. Pity.

Exactly. ALL, ...ALL THE WINESSES, except Deedy's companions testified that he appeared intoxicated and that HE inserted himself into a harmless scenario, threatened to shoot Elderts and initiated the fight by attacking him first with a kick. He did not identify himself and reached for his gun when Elderts got the best of the drunk agent and knocked Deedy down. Whether he had ANY law enforcement authority at all is questionable. Except for Shane Miranda, no witnesses had any relationship with Elderts at all. Drunk and armed and STUPID! Snotnosed greenhorn privileged rich punk deserves life in prison!

Looks like a hung jury thanks to the Judges decision to not offer the entire range of options to the jury. More tax money down the tubes for a retrial.

IRT TKHawaii, either a hung jury or acquittal. If hung, lose money for prosecution AND defense.
