A man stepped in to stop an assault on a 60-year-old woman school bus driver near Kalani High School Tuesday afternoon, police said.

The bus driver was waiting for her passengers just after 3:30 p.m. when a 22-year-old man entered the bus and  assaulted her, police said. That's when a bystander broke up the alleged attack and called police.

Officers arrested the suspect on suspicion of unauthorized entry into a vehicle.

"The suspect was arrested on suspicion of unauthorized entry into a vehicle." But no "Suspicion" of assault? Good one, boys.

Unauthorized entry into a motor vehicle is a Class C felony, punishable by up to five years in prison, whereas assault, without serious or substantial injury is only a misdemeanor offense, The offense of unlawful entry into a motor vehicle is the commission of a crime (any crime, assault, theft, etc.) after entering a motor vehicle without the owner's consent. This offense is similar to burglary. If someone enters another person's residence and punches that person, the assailant will have committed a burglary, a more serious offense than misdemeanor assault. So . . . in this case, they (cops) got it right. "Good one, boys."

without NotNasti's explanation (and assuming it's true), it's hard to fault Carang's reaction, b/c the laymen's reaction would be just that-- what about the assault? Still, good explanation NotNasti.

I agree with you. It is the lay person's reaction. Not Carang's fault. I'm just trying to educate the public, that's all.

So, you'd mentioned entering the "owners" vehicle. In this case, I would rather doubt the bus driver "owned" the bus, so would your explanation still hold true given the ownership of the vehicle?

NotNasti wrote:
Yes, because the bus driver is an "agent" of the owner of the vehicle.
