Driver who killed 2 women back in jail

The teenage driver who was drunk and high on cocaine and marijuana when he killed two women in a 2007 crash in Waimanalo is back behind bars.

Tyler Duarte was 17 years old when he crashed his sport utility vehicle into a sedan near Waimanalo Elementary & Intermediate School on Jan. 10, 2007. The SUV pinned the sedan against a concrete wall, crushing its occupants, a 39-year-old woman and her cousin, a 38-year-old woman, both of Waimanalo.

Duarte pleaded guilty to fleeing the scene of a accident and two counts of negligent homicide. A state judge sentenced him to five years of probation and 18 months behind bars. He completed his jail term on Christmas Eve last year.

But in April he admitted burning someone else's car in an insurance fraud scheme involving the car's owner. Police found the burning car May 17, 2008, in Waimanalo.

Circuit Judge Richard Pollack sentenced Duarte last month to a new five-year term of probation and nine months in jail.

Yesterday another judge restarted the five years of probation in the negligent-homicide case and ordered Duarte to jail for six months because the insurance fraud conviction violated the terms of his original probation. However, Duarte will get to serve the new period of probation and the six-month jail term at the same time he serves his sentence for the insurance fraud.
