Victim's friend testifies in federal agent's murder trial

By Ken Kobayashi

LAST UPDATED: 08:02 p.m. HST, Jul 17, 2013

Kollin Elderts was in good spirits when he left friends in Waikiki to go to a McDonald’s restaurant where he was shot and killed, a friend testified this morning.

Elderts, a 23-year-old Kailua man, had smoked marijuana earlier and had been drinking beer, Malie Goodhue testified.

Goodhue took the stand as the first prosecution witness in the second day of the murder trial of State Department special agent Christopher Deedy.

Deedy, 29, is charged with murdering Kollin Elderts at the McDonald’s restaurant on Kuhio Avenue early Saturday morning, Nov. 5, 2011.

Goodhue testified that Elderts and his friend Shane Medeiros joined her and friends for a night celebrating birthdays in Chinatown the previous Friday night.

She said Elderts had smoked marijuana earlier and had been drinking beer, but said Elderts and Medeiros seemed “fine” before they left to get some food.

“They were happy, tired, but they were happy,” she told the Circuit Court jury.

Goodhue said she never saw Elderts again, and broke down when she testified she later received a call from a police officer telling her that Elderts had been involved in an altercation.

The prosecution is alleging Deedy was driven by alcohol and inexperience when he shot Elderts.

Deedy’s lawyers contend the agent fired in self defense.

Let's just put it out there: for a lot of transplants and tourists, Elderts was the "scary local guy" they obsess about, and Deedy is their fantasy surrogate, dealing a blow against the "reverse racism" they feel is so pervasive in Hawai'i. What has been established however, as NOT being permitted - is as a Federal Agent carrying your weapon when you're consuming alcoholic beverages. If that is established - that Deedy was drinking - that will be a problem for the defense. While Kollin was consuming pot and booze - he didn't have a gun.

If it did, why does the media portray "stoners" as being mellow and lethargic?) - Elderts was convicted of assault (Perhaps relevant) -...and a DUI (Irrelevant. Driving a motor vehicle has nothing to do with this altercation) - Elderts delivered the first blow (Perhaps relevant. But does that justify being shot to death?) So have of your argument is irrelevant. That's pretty weak.

dis"agree" Agent Deedy was a trained federal law enforcement officer and Elderts had no common sense when he GRABBED Deedy's gun. This was after Deedy identified himself as law enforcement, not as a rent-a-cop. If he was some rent-a-cop, like you ignorantly believe because you do not know what you're talking about, he wouldn't have been permitted to carry his firearm at all when "off-duty." BUT he is a federal law enforcement officer, having received similar training in use of force tactics that local LEOs receive. And all LEOs routinely carry while off-duty. The mistake here was Elderts grabbing at Deedy's gun, a sure way to later find oneself six feet under. Deedy had to protectn himself from Elderts taking his gun and using it against him and others in the restaurant.

Elderts had to protect himself after Deedy said he would shoot Elderts, "what you wanna get shot" at point blank, elderts was reaching for the gun, after several shots by Deedy. That spent casing stuck in Deedys glock, was a jam probably from elderts pushing at the barrel. My question, what round struck elderts first? The missed rounds were defensive chucks from elderts. My point round one hits center mass, elderts fears for his life, round two is chucked, round three is chucked when elderts hand hits the barrel and the slide spring defects where the caddying is not ejected. Elderts then fall on Deedy.

Exactly. Deedy is not a cop- he's a guard for diplomats. Having said that, he has to be held to a high level of responsibility as a federal employee carrying a weapon. He is supposed to be more careful and more responsible than the average person- he was the opposite, and he needs to pay for it.

This case is not like Zimmerman/Martin. Zimmerman went after Martin, he chased him down when the police to him not to. Martin was 'drunk' on coke (a-cola) and colorful pills (skittles), not pot, coke and liquor. Martin was defending himself from a person who was being the aggressor. This case Elderts was stoned and drunk, acting like a moke and being aggressive to customers and a (probably intoxicated) Deedy with a gun was provoked and attacked and the stoned drunk moke grabbed his gun.
