Big Island councilman gets jail time

HILO > Disregarding a plea agreement, Circuit Court Judge Ronald Ibarra has sentenced Hawaii County Councilman Kelly Greenwell to 30 days in jail, with all but five days suspended.

   The 69-year-old Greenwell had pleaded no contest to resisting arrest July 17 when he was stopped for speeding.

   West Hawaii Today reports the agreement that dropped charges of resisting an order from a police officer and refusal to provide identification did not include jail time.

   During Monday’s sentencing, Ibarra told Greenwell he should have submitted to police even if he thought the arrest was unlawful.

   Ibarra gave defense attorney Eric Seitz 10 days to appeal the sentence.

   Greenwell lost his bid for re-election in September.
