The man fatally shot by police after a robbery at the Waimalu Shopping Center tested positive for crystal methamphetamine, the Honolulu Medical Examiner’s Office said today.

Herbden Gabriel, 46, died of injuries to his lung and an artery after receiving a single gunshot wound to his chest, the Medical Examiner’s office said. Preliminary toxicology tests tested positive for crystal methamphetamine.

An off-duty police officer on special duty shot Gabriel at least once in the torso Tuesday afternoon.

Police said Gabriel was holding a handgun and refused to drop it. Police and witnessess said Gabriel was running from the shopping center after robbing a woman at Pukana La Massage office on the second floor of the center.

Gabriel has a criminal record of 11 convictions from 1984 to 2001, including kidnapping, robbery and assault.

Prison records show Gabriel was paroled on March 16, 2006, after serving nearly five years on forgery charges.

Gabriel was under the supervision of a parole officer until March 30, 2009, when he was discharged from the system, said Tommy Johnson, the paroles and pardons administrator for the Hawaii Paroling Authority. The discharge took place three years, nine months early due to good behavior, Johnson said.

He declined to go into specifics of Gabriel’s release, citing Hawaii privacy laws.

During parole, parolees are drug tested regularly.
