A state judge sentenced a man to 10 years in prison this morning for running over and killing a 20-year-old woman in the drive-through lane of a McDonald’s restaurant in Nanakuli two years ago

The judge also ordered Albert Birmingham to serve at least three years and four months behind bars before he is eligible for parole because he has a prior felony conviction. The Hawaii Paroling Authority can set a higher minimum.

Birmingham, 38, was facing a mandatory 20-year prison term for manslaughter for killing Raelynn "Aloha" Adams Jan. 31, 2010 at the Nanakuli McDonald’s. He pleaded guilty to first-degree negligent homicide in February in a plea deal with the prosecutor.

Birmingham also pleaded guilty to fleeing the scene of a fatal traffic accident, operating a vehicle while consuming or possessing alcohol and driving after his license had been revoked for drunken driving. He has twice been convicted of drunken driving.

Police had said Birmingham was honking his horn at the car ahead of him in the drive-thru lane when the driver of the car, a 45-year-old Mililani man, confronted him. When Adams and a teenage girl, who were passengers in the front car, intervened, Birmingham drove his vehicle forward, running over Adams and striking the girl.

Birmingham drove off, but police found him nearby, lying inside his parked vehicle. The prosecutor said Birmingham’s blood-alcohol content was 0.132. The legal threshold for drunken driving is 0.08.
