An arbitrator has awarded the owners association of a Hawaii island luxury condominium project $1 million in a dispute over leaking condo lanai.
Keith Hunter issued the award to the Associa- tion of Apartment Owners at the Fairways at Mauna Lani condominium project against general contractor Metcalf Construction Co. and subcontractor Waikoloa Tile, which did the lanai work.
Hawaii island attorney Jerry Hiatt, who represented the association, said Hunter issued awards of $465,740 against the Metcalf company and $578,769 against Waikoloa Tile.
The awards covered the cost of repairs and included more than $200,000 for the association’s attorney fees, Hiatt said.
In the ruling, Hunter said the evidence showed there was "no dispute that the lanai waterproofing as installed by (Waikoloa Tile) was not waterproof."
Also, Metcalf Construction failed to "properly oversee" Waikoloa Tile’s work, Hunter said.
Hunter issued the final award earlier this month.
Hiatt said all 84 lanai floors in the 126-unit condo project had to be repaired.
Roy Hughes, Waikoloa Tile’s lawyer, said he was not at liberty to comment. Alan Tuhy, Metcalf Construction’s lawyer, said he was preparing a response.
