Man who killed pet pig gets 9-day jail sentence
LIHUE >> A Kauai County man found guilty of criminal trespass for stabbing someone’s pet pig to death in 2013 has been sentenced to nine days in prison.
Prosecutors dropped charges of cruelty to animals and criminal damage against Noah Jeriamiah Elija Smazik of Hanalei, The Garden Island reported.
Prosecutors said Smazik, 33, had help from an accomplice when he illegally entered a fenced property and fatally stabbed the 400-pound domesticated pig.
Co-defendant Bronson Howard served 24 days in jail after being found guilty of second-degree criminal trespass. He was acquitted of animal cruelty and criminal property damage charges.
“The apologies are not for killing the pig itself but for the trauma that the victim went through in coming down and seeing Mr. Smazik and Mr. Howard over her pet pig that she had raised from a ‘squiglet’ or piglet, and seeing Mr. Smazik multiple times stab the pet pig,” said Deputy Prosecutor George White.
Stephanie Char, Smazik’s attorney, had argued for probation and community service, saying Smazik had stayed out of trouble since the 2013 incident and that he had two children to look after.
“Serving time in jail would be a hardship for himself and his family,” Char said.
Fifth Circuit Court Chief Judge Randal Valenciano denied requests from both White and Char to have Smazik do community service. He handed down the nine-day jail sentence instead.
Smazik apologized for “killing the pig” in court Tuesday and said the court process has been hard on him.
He has a long criminal history, which includes prior convictions for terror threat in the second degree in 2008, criminal contempt of court in 2004 and resisting arrest in 2003.

So who ate the pig? The way I see it in the article the owner lost a living asset. When my neighbors dog breaks into my hen house and kills all of my chickens is it criminal trespass?
Kauai gets more and more bizarre and dangerous. Sad.
Even a nonhuman pig deserves better justice. I’d term Smazik’s act a crime of violence, much worse than taking a sledgehammer to somebody’s car or house.

It’s taken since 2013 to wrap this up? And looks to be handled poorly by our criminal justice system too. Too bad we don’t have a victim’s justice system…:(
So what if he finds being in jail a hardship. Why did he do it in the first place? Lock his ass up and he needs to stop making sorry ass excuses for his behave. Lucky he lives in Kauai. If he had done this in some other state he may have gotten shot.
Judge went easy on him because of his 2 children. His abettor received a stiffer sentence? Auwe, go figure.

What a travesty. This guy says that this has been hard for him…serving jail would be hard for him & his family…What about the family who had to watch their pet get murdered? 9 days??? Judge Randal Valenciano needs to do some time for this injustice.
I agree, the prosecutor and judge should pay a fine for this taking so long only to have him laughing in the face of the justice. Isn’t the point of prison that it is a “hardship” for someone who breaks the law?
So what does the pet owner get out of this. Sure as heck their not going to eat their pet.

What’s going to happen to that guy who was arrested recently for shooting and killing a dog? That guy didn’t even “criminal trespass”. 4 days? Hahahaha!
So why did this person kill the pet pig? Was it to spite the owners? Did he know it was a pet? Why would he enter a fenced yard to kill it? I realize this is just a news article but why so many holes in this incomplete story?
I’d say the wrong pig got stabbed.
This guy has a long criminal record. 9 days is not going to stop this career criminal and the next time, his victim might be a fatality.
