A 45-year-old man charged with attempted murder shot at a couple in Waianae
because he mistakenly thought the woman was his longtime girlfriend, whom he had accused of cheating, according to court documents.
Brian A. Magsayo made his initial court appearance at Honolulu District Court Wednesday after prosecutors charged him with first-degree attempted murder, two counts of second-degree attempted murder and two counts of carrying a firearm in the commission of a separate felony.
His bail was set at $200,000 for the attempted murder case and $100,000 in connection with a terroristic threatening case in which he threatened to shoot his girlfriend at a Makaha nursing facility and “anyone else
who got in his way,” according to court documents.
At about 10 p.m. Saturday, a 19-year-old man and 20-year-old woman were eating inside their vehicle in the parking lot of Kentucky Fried Chicken on Kaupuni Street.
As the 19-year-old man
reversed his vehicle to exit the lot, police said another vehicle entered the area and blocked the exit. A suspect later identified as Magsayo exited the vehicle and wielded a firearm believed to be a rifle, police said.
Police said the suspect
approached the victims’ vehicle while pointing the firearm at them. The driver quickly reversed his vehicle but struck a curb, causing one of his tires to flatten.
Magsayo ran toward
them as the vehicle reached Farrington Highway. At that point, police said, he allegedly shot at the couple, with rounds striking the trunk and rear window of
the vehicle.
The rounds shattered the window and struck the 19-year-old man’s right shoulder as he and the woman sped away in the vehicle. The woman, who was seated in the front passenger
seat, sustained an ear injury from the shards of window glass.
Police said the victims do not know Magsayo and no words were exchanged prior to the unprovoked shooting.
The following night,
Magsayo allegedly drove to a Makaha nursing facility at
84-390 Jade Street at about 6:45 p.m. Police said he screamed for his girlfriend as he sat in his car with a rifle.
A friend, who was at the
facility visiting a family member, recognized Magsayo
and asked him what he was doing there, police said. Magsayo told her his girlfriend was cheating and that he was going to “shoot up the place,” police said. He also admitted he was the assailant in the shooting at the fast-food restaurant parking lot Saturday night, police said.
The woman immediately returned to the nursing facility and informed her family members as well as employees at the facility.
Police said two men who also know Magsayo walked to the front lobby and observed him armed with a rifle while hiding in some nearby bushes. The men told officers that they heard “what sounded like Magsayo ‘racking’ the rifle,’” the court document said.
They then saw Magsayo tucking the rifle underneath his jacket and pacing near the parking lot entrance of the facility, police said. At some point, he returned to his car and drove off.
Police responded and located Magsayo nearby and arrested him on suspicion of multiple counts of terroristic threatening.
While in custody, he was positively identified as the man who shot at the couple Saturday night, police said.
