Colt Brennan was highly intoxicated when he was pulled over by a police officer for allegedly speeding July 25 in Kailua.
His blood alcohol content was 0.171, more than twice the legal limit of 0.08, according to a police report released Tuesday by the Administrative Driver’s License Revocation Office.
Brennan was arrested at 11:50 p.m. July 25 for investigation of drunken driving and promoting a dangerous drug. He was released the next morning without charges.
A spokesman for the prosecutor’s office said Brennan had not been charged by Tuesday afternoon; Brennan must be charged with both offenses at the same time because they are connected, unless one offense is dropped. The delay might be related to the police investigation or lab tests for the substance believed to be an illicit drug.
Brennan’s attorney Michael Green said his client is struggling to cope with his arrest, being cut from the Canadian Football League and the lingering injuries from a Hawaii island car crash. "He needs treatment, right away," Green said. "He’s just so incredibly depressed about what happened to him."
He said Brennan’s parents are in Hawaii while he is being evaluated for drug, alcohol and medical problems related to the 2010 car crash.
"My focus for this case is to make sure that when we leave this case, Colt gets the best possible treatment that he can get, whether it’s drugs, whether it’s alcohol," he said.
According to the police report of last week’s arrest, an officer stopped Brennan’s maroon Chevy Cruz rental car for going at least 10 mph over the 25 mph speed limit near Kalanianaole Highway and Kailua Road.
The officer said Brennan’s eyes were red and watery, his speech was slightly slurred and he had a strong odor of alcohol on his breath. He was also unsteady getting out of the car, the officer reported. Brennan told the officer that he was driving to a friend’s house in Hauula.
Brennan took off his slippers to take the field sobriety test and lost his balance three times while trying to walk an imaginary line on the sidewalk, the report said. A preliminary breath test showed Brennan had a blood alcohol content of 0.189.
The officer said after receiving Brennan’s permission to move the rental car to a nearby parking lot, he opened the car door and noticed a 1-inch-square green translucent cellophane bag containing a white powdery substance, believed to be an illicit substance, between the driver’s door and the seat. The officer also noted that the vehicle smelled strongly of marijuana.
The Administrative Driver’s License Revocation Office has suspended Brennan’s license for one year beginning Aug. 25, and he has until Sunday to request a hearing to contest the decision.
