The driver who police said was racing with the driver that caused the crash that killed 11-year-old Samuel Kassebeer in Waimanalo two years ago pleaded no contest in state court Tuesday to negligent homicide instead of manslaughter.
Travis Murray, 22, also pleaded no contest to two counts of assault for the injuries two of Kassebeer’s aunts suffered in the crash. He faces maximum five-year prison terms for each of the three charges when he is sentenced in December.
Kassebeer was the rear-seat passenger of a car that was hit from behind as it was making a left turn into the driveway of his family’s home fronting Kalanianaole Highway. The impact ejected Kassebeer from the car. He was pronounced dead at the scene.
One of Kassebeer’s aunts was driving, and the other aunt, whom the impact ejected, was the front-seat passenger.
A city prosecutor said Herbert Kaio-Campbell, the driver of the second car, had a blood alcohol content of 0.10 and that his car was traveling at 77 mph at the time of impact. The speed limit there is 35 mph.
Kaio-Campbell was 20 years old at the time of the crash. It is unlawful for anyone under 21 to operate a vehicle with any amount of alcohol in his system. The drunken driving threshold for anyone 21 or older is 0.08 BAC.
Police said Murray, who was racing with Kaio-Campbell, fled the crash scene.
An Oahu grand jury charged Kaio-Campbell and Murray each with manslaughter and assault.
Kaio-Campbell pleaded no contest to the charges in January. However, two days before his scheduled sentencing in March, he was found dead at his family’s home from an apparent suicide.
