Murder suspect is unfit for trial
A 56-year-old homeless man accused of shooting another homeless man to death on the Hilo Bayfront last year has been found unfit to stand trial for second-degree murder.
Hilo Circuit Judge Greg Nakamura ruled Monday there is "clear and convincing evidence" that Mark Anthony Whyne "lacks the capacity to understand the proceedings against him or to assist in his own defense," the Hawaii Tribune-Herald reports. The judge ordered Whyne committed to the Hawaii State Hospital, run by the state Department of Health.
Psychologist Tom Cunningham testified that Whyne suffers from schizophrenia.
Whyne, a former special-education teacher at Pahoa and McKinley high schools, is accused of shooting Faafetai Fiu, 32, eight times on Dec. 29, 2012, near Mooheau Park. Police found a 9 mm handgun in Whyne’s fanny pack when they arrested him Feb. 4, and the ballistics matched.
