KonaRed to pay fees in patent settlement
KonaRed, a Hawaii company producing beverages made with extract from the fruit of Kona coffee, has agreed to pay another company for alleged patent and trademark infringements.
Kauai-based KonaRed announced Monday that it has settled a lawsuit brought by VDF FutureCeuticals Inc., an Illinois-based company involved with the competing SoZo Coffeeberry drink.
Under the settlement, KonaRed agreed to pay undisclosed fees for VDF patent and trademark rights. The fee obligation is secured by KonaRed property and gives VDF the right to take its fees in the form of KonaRed stock.
The settlement also requires KonaRed to buy its raw materials from VDF starting in 2017.
VDF sued in 2011, alleging that KonaRed infringed on three patents and violated a trademark for "Coffeeberry" by using the term "coffee cherry." KonaRed tried to invalidate VDF’s patents through the U.S. Trademark and Patent Office, but that effort wasn’t successful.
