A federal judge has ordered an Ewa Beach man accused of producing child pornography to remain in custody without the opportunity for release on bail pending trial.
A federal grand jury returned an indictment April 10 charging Feliciano Lou Quimoyog with three counts of producing child pornography between 1995 and 2000. Each charge carries a minimum penalty of 15 years in prison and a maximum of 30 years.
The FBI arrested Quimoyog at his home Monday.
At a bail hearing in U.S. District Court on Friday, defense lawyer Victor Bakke asked the judge to release Quimoyog into the custody of his adult daughter.
Bakke told U.S. Magistrate Judge Richard L. Puglisi that Quimoyog has no job and is primary caregiver for his 89-year-old mother. He said the charges do not involve the Internet, but something that was going on in the home and that his daughter will assure that there are no children in the household.
Prosecutor Andrea Hattan told Puglisi the charges against Quimoyog do involve the Internet and that the weight of the evidence against him is very strong. She said Quimoyog poses a clear and convincing danger to the community because of his arrest and methamphetamine abuse history. She also said Quimoyog poses a risk of flight if released because he has no financial ties to the community.
Puglisi said because of Quimoyog’s criminal record, substance abuse and history of violence, he doesn’t even qualify for release to a halfway house.
