State gets OK to evict World Gym Honolulu
A state agency has been freed to evict World Gym Honolulu from a state building in Kakaako after a judge rejected an attempt by an affiliate of the gym’s owner to resolve its delinquent rent in U.S. Bankruptcy Court.
Bankruptcy Judge Robert Faris dismissed the case of Gap Fitness Partners LLC on Thursday. Faris dismissed the case after Gap Fitness failed to respond to a motion made by a court-appointed trustee to either liquidate company assets or dismiss the case, according to court records.
Gap Fitness, which does business as World Gym Honolulu and is led by John J. Michael of Woodinville, Wash., filed a Chapter 11 bankruptcy petition in February seeking to reorganize what it said was its only debt: $230,000 in overdue rent.
The Hawaii Housing Finance and Development Corp., a state agency that helps develop affordable housing and owns the space at 1050 Queen St. occupied by World Gym, sued Gap Fitness and Michael in October to evict the gym. After prevailing in the lawsuit, Gap Fitness filed bankruptcy, which automatically suspended the eviction effort.
