A class-action lawsuit was filed Tuesday in Oahu Circuit Court on behalf of patrons of Genki Sushi who obtained vaccinations or immune globulin shots to keep from falling ill with hepatitis A.

The suit was filed on behalf of Bryan K. Cuelho, a Waialua resident, and others similarly situated, against Genki Sushi U.S.A. Inc., Koha Foods Inc. and Sea Port Products Corp. It was brought by the Honolulu law firm of Starn O’Toole Marcus & Fisher, in partnership with Seattle attorney Bill Marler.

“This is basically for people who were at risk because they ate at Genki but then got the shot to hopefully prevent themselves from getting sick,” attorney Trevor Brown said.

The goal is to compensate them for the shock, discomfort, time and expense of medical treatment to avoid getting the disease.

Last week health officials found that contaminated scallops were the source of the hepatitis A outbreak. The seafood was imported from the Philippines by Sea Port Products and distributed by Koha Foods to Genki Sushi.
