A Circuit Court judge has dismissed a February sexual assault case against a 32-year-old man in Honolulu.
Judge Rom Trader dismissed a charge of first- degree sexual assault and one count of abuse of a family or household member against Ioannis G. Broutzakis on June 19 because prosecutors were unable to subpoena the victim, said Broutzakis’ attorney, Victor Bakke.
Prosecutors charged Broutzakis in February with sexual assault and abuse involving a 37-year-old woman. Police said the woman reported that Broutzakis assaulted and choked her in Honolulu.
According to court records, an Oahu grand jury indicted him in March, and his trial was set for May. Trader rescheduled the trial to July after prosecutors indicated the woman was on the mainland.
On June 19 the state requested a continuance on the trial because it was unable to subpoena the victim. Trader denied the request and dismissed the case without prejudice, which means prosecutors can refile the case at a later time.
