Federal agent Christopher Deedy has joined in the Honolulu Star-Advertiser’s request for an order from the Hawaii Supreme Court prohibiting a state judge from holding closed court sessions in his murder case without giving the public a chance to object.
The request by the newspaper and Hawaii News Now filed last month also asks the high court to release the transcripts of the closed proceedings.
Deedy’s attorney Thomas Otake filed papers Tuesday with the high court saying they adopt the arguments by the Star-Advertiser and Hawaii News Now.
Circuit Judge Karen Ahn held a private bench conference with the jury out of the courtroom and then cleared the court before she declared a mistrial in Deedy’s murder case in August.
The jury reported it was not able to reach a verdict on whether Deedy murdered Kollin Elderts in the 2011 shooting at a Waikiki McDonald’s restaurant.
Ahn has scheduled jury selection for the retrial to begin in June.
Other news and media organizations filed a friend-of-the-court brief this week supporting the request by the Star-Advertiser and Hawaii News Now.
The high court had directed Deedy, Ahn and city prosecutors to file their responses to the request by this week.
