State drops challenge to PAC donation limitations

The state of Hawaii has dropped an appeal of a law that sought to limit contributions to political action committees.

The action allows Hawaii residents to donate as much as they want to political action committees, and it invalidates a $1,000 limit on contributions passed into law by the state Legislature.

The Associated Press learned Monday that the 9th U.S. Circuit Court of Appeals in San Francisco granted the state’s dismissal request last week.

Hawaii Campaign Spending Commission Executive Director Kristin Izumi-Nitao said the case shows how last year’s landmark Citizens United decision by the U.S. Supreme Court is affecting state campaign finance laws.

She said courts are ruling that fundraising and spending by PACs are forms of free speech protected by the U.S. Constitution.
