Judge to rule on whether to dismiss Say residency challenge

Circuit Judge Karen Nakasone said Thursday that she intends to rule on whether to dismiss a residency challenge to state Rep. Calvin Say by Sept. 30.

Six Palolo voters have alleged that Say does not live in the state House district he has represented since 1976.

Say — and the House — argue that under the state Constitution, only the House can judge whether a lawmaker is a qualified voter of the district they represent. Both the former speaker and the House have asked the judge to dismiss the residency challenge.

Say has said he lives in a 10th Avenue home in Palolo but spends time at a home in Pauoa Valley for family reasons.

Say, a Democrat, is facing Julia Allen, a Republican, and Keiko Bonk, a Green Party candidate, in the November election.
