DOE failed to protect rape victim, jury finds

A jury has found that Hawaii’s public school system failed to protect a special-education student who says she was raped by a classmate.

Monday’s verdict also says the state Department of Education and a special-education teacher at Waianae High School didn’t act recklessly or intentionally.

Jurors deliberated for two days in a lawsuit filed by Mariana Harris’ mother, saying the girl, now 19, was raped by a boy from her special-education class in a unisex bathroom in 2013. The Associated Press doesn’t usually identify sex assault victims unless they choose to go public. Harris and her mother say they want to help other victims.

The jury awarded $810,000 in damages. Lawyers had asked for $3.2 million.

A deputy state attorney general defending the department and the teacher says she’s disappointed by the verdict.

Clues sought in cemetery vandalism

Hawaii County police are asking for help to catch a vandal or vandals who knocked over grave monuments and smashed concrete vase holders at the Kapoho Zairyumin Kai Japanese Cemetery on Kapoho Lighthouse Road in April.

Police said the damage, estimated at $4,200, happened sometime between April 10 and 21, when a cemetery caretaker discovered the damage.

Police ask anyone with any information about this case to call officer Roberto Segobia at 965-2716 or the Police Department’s nonemergency line at 935-3311.

Tipsters who prefer to remain anonymous may call CrimeStoppers at 961-8300.

Vendors can apply for Kauai’s Sunshine Market

Kauai County officials are accepting applications for vendors in its Sunshine Market program.

According to a county news release Monday, there are openings at the following markets:

>> Kalaheo Neighborhood Center, 3-4 p.m. Tuesdays

>> Kapaa New Town Park, 3-5 p.m. Wednesdays

>> Old Hanapepe Town Park, 3-4:30 p.m. Thursdays

>> Vidinha Stadium, 3-5 p.m. Fridays

>> Kekaha Neighborhood Center, 9-10 a.m. Saturdays
