PALM BEACH, Fla. >> President Donald Trump lashed out Saturday at “this so-called judge” who put a nationwide hold on his executive order denying entry to the U.S. to refugees and to people from seven predominantly Muslim countries. The ruling set in motion another weekend of confusion and chaos around the country.
The White House pledged to swiftly appeal the federal judge’s ruling late Friday, but that didn’t appear to be enough for Trump, who vented his frustrations on Twitter.
“The opinion of this so-called judge, which essentially takes law-enforcement away from our country, is ridiculous and will be overturned!” Trump said.

The government moved quickly to comply with the judge’s order. The State Department reversed visa cancellations for foreigners, and the Homeland Security Department said it’s no longer directing airlines to prevent affected visa-holders from boarding U.S.-bound flights.
Up to 60,000 foreigners had their visas “provisionally revoked” to comply with Trump’s order, which the president has said will keep Americans safe at home by keeping potential terrorists from entering the country.
Trump also said Saturday on Twitter that “when a country is no longer able to say who can and who cannot come in & out, especially for reasons of safety & security — big trouble!”
U.S. District Judge James Robart in Seattle ruled late Friday against government lawyers’ claims that Washington state and Minnesota, which sued over the ban, lacked the legal grounds to challenge Trump’s order. Robart said the states showed that their case was likely to succeed.
White House press secretary Sean Spicer said late Friday that the Justice Department would appeal the “outrageous” order “at the earliest possible time. Spicer quickly issued an amended statement that deleted “outrageous.”
“The president’s order is intended to protect the homeland and he has the constitutional authority and responsibility to protect the American people,” Spicer said, calling the order both lawful and appropriate.
Trump billed the action as necessary to stop “radical Islamic terrorists” from coming to the U.S.
The order included a 90-day ban on travel to the U.S. by citizens of Iraq, Syria, Iran, Sudan, Libya, Somalia or Yemen, a 120-day suspension of the U.S. refugee program, and an indefinite bar against admitting Syrian refugees.
The decision sparked protests nationwide and confusion at airports as some travelers were detained. More protests were planned for this weekend, including at Trump’s estate in Palm Beach, Florida, where he is spending the weekend.
Last week, U.S. District Judge Ann Donnelly in New York issued an emergency order after lawyers for the American Civil Liberties Union filed a court petition on behalf of people from the seven countries who were detained at airports nationwide as the ban took effect.
Donnelly’s order addressed only a portion of Trump’s order, and barred U.S. border agents from removing anyone who arrived in the U.S. with a valid visa from the seven countries. Robart’s decision was more sweeping in scope.
Saturday was not the first instance of Trump criticizing a federal judge, a member of an independent branch of the government.
During the presidential campaign, Trump repeatedly criticized the federal judge who was presiding over a lawsuit brought by former students of Trump University. Trump claimed that U.S. District Judge Gonzalo Curiel, who was born in Indiana, had an “absolute conflict” in handling the case because he is “of Mexican heritage.” Trump launched his presidential campaign with a harsh description of Mexican immigrants as rapists and drug dealers.
Trump recently agreed to pay $25 million to settle the lawsuits against Trump University.
Dictators don’t like it when someone makes them follow the rules. Trump’s order won’t make America safer from Islamic terrorism or any other kind. The problem is that the so called travel restrictions were so fake. The guys who attacked us on 9-11 were mostly Saudis and Egyptian, yet the ban did not include Saudi Arabia or Egypt. The guys who bombed the Boston Marathon were originally from Kyrgyzstan before coming to the US. Yet Kyrgyzstan is not covered by the ban, and the San Bernardino shooters were Pakistani (one was born in the USA) but Pakistan, which is a country that seems to support folks like the Taliban is not on the list. This whole so called ban does not keep us safe as it excludes countries whose citizens have actually attacked us. It was really just a political ploy to feed red eat to the Trump’s base.

1. Equal Protection. This order raises discrimination concerns surrounding the Equal Protection Clause of the 14th Amendment, singling out individuals for their religion and nationality by focusing on seven predominantly Muslim countries. Additionally, our immigration laws already forbid such discrimination in issuing visas.
2. First Amendment. The order raises religious freedom concerns, including issues surrounding the ban on government establishment of religion. The law suspends admission of all refugees but asks the secretary of homeland security to “prioritize refugee claims” by members of a “minority religion” in a given country. This effectively means explicitly de-prioritizing Muslim refugees in majority-Muslim countries. As Mark Joseph Stern has explained, the apparent preference for Christians of the order itself as well as Trump’s long history of comments supporting a “Muslim ban” will not help the law’s success in the courts.
3. Due Process. The procedures used to enforce the order, if they can be called procedures, are arbitrary. Past Supreme Court cases have permitted individuals to be excluded at the border but only after some modicum of individualized review and administrative process, authorized by laws and regulations. A lack of due process under the Fifth and 14th amendments for those affected should not be hard to show, considering the hasty, sweeping changes enacted without administrative process or legislation, confusion on the ground, and reports of outright refusal to follow court orders. Moreover, green card holders have enhanced rights compared to non-green card holders against arbitrary treatment.*
4. Habeas Corpus. Lawyers at airports have been filing habeas corpus petitions around the clock for people being detained. In recent years, the Supreme Court strengthened the protections of habeas corpus for noncitizens repeatedly in rulings in cases brought by Guantánamo detainees. Less known were earlier rulings strengthening protections for noncitizens in detention facing removal, such as Zadvydas v. Davis. The national security or “plenary” power over immigration did not faze the justices in such rulings.
5. Family Reunification Rights.* The tragic stories of separated families bring out yet another constitutional right at stake that few have commented on: The Supreme Court has repeatedly recognized the importance of the fundamental right to family relationships. Family reunification is also of primary importance in immigration law.
The Supreme Court’s ruling in Obergefell v. Hodges emphasized how multiple constitutional rights magnified the harm of denying same-sex couples the right to marry. “The Due Process Clause and the Equal Protection Clause are connected in a profound way,” Justice Anthony Kennedy wrote for the majority. The constitutional violations in that case were made worse because there was discrimination—over something as important as the fundamental right to marry. Today, these constitutional violations are worse because the order discriminates on the basis of religion, nationality, and ethnicity, over rights as important as due process, the right to family relationships, and the right not to be excluded unlawfully. The equal protection, due process, First Amendment, habeas, and fundamental rights violations that we describe are important standing along but even more devastating to the legality of the order when seen in tandem. As we have written in a 2015 article, constitutional rights magnify their power when they share reinforcing interests.*
There will always be cases where national security interests outweigh constitutional rights. But those should be handled on a case-by-case basis and not as a ban that stereotypes and discriminates against an entire group of people. Lawmakers should step in to reaffirm through legislation that national security regulation can be done right, and constitutionally. In the meantime, the courts should strike down this order as unconstitutional in its entirety.*

Trump is being out-smarted (no surprise there) and out maneuvered by hundreds of lawyers who have joined forces to stop his illegal and unconstitutional nonsense. Trump, obviously, is profoundly mentally ill.
The president’s authority to declare such suspensions can been found in section 212(f) of the Immigration and Nationality Act, the pertinent part of which reads as follows:
“(f) Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.”
“A visa does not guarantee entry into the United States. A visa allows a foreign citizen to travel to the U.S. port-of-entry, and the Department of Homeland Security U.S. Customs and Border Protection (CBP) immigration inspector authorizes or denies admission to the United States.”
Not sure how all this is going to play out in a court of law but I do know that it would not be the first time some loud mouth condescending bloggers would end up being the south end of a north bound donkey.
Equal protection under the law, in the Constitution, Trump cannot ban a whole religious group from entering the country. Like you cannot discriminate against any race, any sex, any belief, religious or secular, any sexuality, any culture, any religion, any political party.
Trump’s argument will be that this is not discrimination but to defend against an anonymous enemy of which we cannot identify. All of us would like to deny that terrorism does not exist and once we allow it to enter our homeland it will be impossible to extricate. We must set strict standards in regards to who comes and goes. Security experts will argue if the Constitution was written at a time of peace or a time of an unconventional war. Common sense can prevail over the Bible as well as a Constitution written on values.
Trump’s Muslim refugee ban does not include Saudi Arabia, Pakistan, Afghanistan, Kazakstan, Indonesia, Malaysia, all Muslim majority countries. 17 of the terrorists on 911 were from Saudi Arabia. Saudi Arabia has also spread Salafism, the extremist form of Islam. Pakistan was the refuge of Bin Laden for many years. So if Trump is trying to protect the US from Muslim terrorists, why are these countries excluded from his travel ban? Does Trump have business interests and investments in those countries, Trump branded hotels, oil investments, other conflicts of interest. There needs to be more transparency of Trump’s business empire, and releasing his tax returns would show his relationship with all these Muslim countries and with other countries in the world, especially Russia.

The underlying problem is not the interpretation of the constitution, it’s all of the President’s detractors who are trying to find anything to delegitimize the President’s authority. The President put this executive order to temporarily halt immigration from 7 terrorist countries which the Obama administration identified, for 90 days so they could re-institute a more effective vetting process to help keep our safe.
Why can’t you gives this president a chance? As a retired veteran, I appreciate safety and I should not have to worry about getting blown up or shot randomly when I travel the US or go to an event. We all derserve to live in the security blanket and safety of this great country which many of us fought for in wars we never should have been in the first place. Whether this executive order leads to actions to keep Americans safe still remains to be seen but at least this president is taking action.

The Washington State AG who argued the request to temporarily block Trump’s ban also brought similar suits against Obama. The AG and the judge used the precedent of a lawsuit brought and won by Republicans as one basis for his ruling. I hold Bannon as responsible for,this more than Trump. Bannon is deceiving and using Trump to advance his use of chaos and disruption to bring down the government– all the executive orders, ignoring congress, not reading and vetting the orders but just throw 30 to 50 orders out there. Bannon is not letting other staffers and attorneys see the orders before Trump signs.

This is why we have an independent judiciary. No one would be able to locate a spine in an x-ray of Mr. Ryan, so the House is not going to stop Mr. Trump. It will be the court that stops him.

Why would it matter? The judge is an American citizen, sworn to uphold the constitution, like our president. His personal beliefs shouldn’t come into question, unless they lead to a bias that can be provably shown to influence his decision. The idea that all belivers in Islam are terrorists out to destroy our country is rubbish, and the idea of singling out a particular race or religion for governmental treatment is what brought us World War II.

Actually, if you had read the story before going off on your rant, you would know that the Judge cited in his ruling as precedent a ruling of a Texas Federal Judge throwing out a EO of Obama’s. But Trump blasts any Judge that rules against him, if you recall. Why one of them doesn’t cite him for contempt of court, I don’t know.

IF ,in the future something tragic happens here and we get an actual terrorist attack from these people, then let’s just hold these Judges accountable and make them known to the Public that it was the same judges(on their watch) that allowed them to come in. Also let the families who suffered loses, to file lawsuits against these Judges and the States.

Somewhat premature in some ways, but the immediacy of this action was to prevent the terrorist from having advance notice and thereby loading up on sending their people to the USA. Let things flow like in nature, don’t try to add, block or change the meaning of the original issue. Agree that for law creation and revision, he’ll need to work with Congress. However, Trump’s executive orders is the same path that Obama took as he was unable to break the gridlock on the hill. It’s just amazing how fast Trump is pushing issues along, good or bad depending on where you sit. And yup, he’s going to find out how slow the government is to change as compared to a business. But maybe he’ll do some innovative things to make the government more businesslike; LOL, wishful thinking. Unfortunately it’s nearly impossible to change the system so the best he can do is hiring freezes, budget controls, eliminate non-productive executive orders [yes, there are at least some if not many], etc. It’s understandable folks are frustrated but we may want to take a step back and think about why Trump won, e.g. nearly half of Americans reached their limit on politics as usual [and Obama is a key reason for this although SA won’t talk about it since they’re pro-Obama]. However,if a threat or Terrorist attacks does result from inflow of these specific refugees? President Trump will have a lot of Ammo to question the Judges credibility and reasoning for this “Hold” on the Temporary Ban . This will definitely be a “I told you so kinda Moment”! Should something Tragic happen.

I think that the people who support the mass immigration of Muslim groups into a Christian environment need to look at the results of Austria, France, Germany, etc. and the impact it has had on their public systems. It has gotten so out of hand that it is becoming a nightmare for these countries to maintain for their own citizens. These immigrants are coming here because they live under tyrannical rule and are oppressed and Christians can relate & sympathize to this. But Americans should realize that allowing Islam to enter in masses into the country will change many local cultures and way of life as they do not assimilate well with opposing religions and views. If they can swear allegiance to our country and democratic values, can demonstrate self sufficiency, religious tolerance, respect for women and are willing to contribute to America’s goals, by all means welcome. Otherwise stay home and fix your own countries ills by gathering and protesting like you do in America. Oh, and take our liberals with you to show them how well your gathered voices are tolerated and how a real dictator answers.
