Jurors are deliberating in the retrial of U.S. State Department Special Agent Christopher Deedy, charged with murder in a Waikiki shooting.

A spokeswoman for the state judiciary says the jury began deliberating Tuesday afternoon.

Deedy is accused of second-degree murder in the fatal shooting of 23-year-old Kollin Elderts in a Waikiki McDonald’s restaurant in November 2011.

His first trial ended in a hung jury last August when the jury could not agree on the second-degree murder charge and did not have the option of convicting him of a lesser charge.

In the retrial, however, Judge Karen Ahn will allow the jury to consider a lesser charges, including manslaughter.

Deedy, a Washington, D.C.-based federal agent, was in Honolulu to provide security for the Asia-Pacific Economic Cooperation meeting in Waikiki.

The prosecution contends that Deedy was drunk and leery of “locals” who were hostile to outsiders. The defense argues Elderts was the aggressor in the fight and that Deedy shot the Kailua man in self-defense.
