SANTA CLARA, Calif. >> A newly released police report alleges San Francisco 49ers fullback Bruce Miller was arrested after knocking down his fiancee and destroying her phone.

The San Jose Mercury News reported Friday that the Santa Clara County district attorney’s office is mulling whether to file charges.

The police report alleges that the 27-year-old and his fiancee were arguing outside a restaurant when he pushed her to the ground at about 10:30 p.m. Miller was arrested two hours later at a nearby hotel on suspicion of misdemeanor spousal battery.

Miller has not commented and his agent didn’t return calls. The 49ers have not suspended Miller and say they are investigating. The NFL league office also said it intends to review the case.
