Boy, 9, arrested in assault of Kaneohe teacher

The Family Court has been given the case of a 9-year-old boy who allegedly assaulted a teacher at a Kaneohe school Tuesday morning.

The boy was arrested at 11 a.m. after he allegedly threatened and assaulted a 45-year-old female teacher. The youth was released to the jurisdiction of the Family Court later that same day. No other details were released since the suspect is a minor.

    Unfortunately, these things happen. I would’ve rather the child was detained by HPD, Arrest is a strong word.

      Don’t worry “BADPAPA” name seem appropriate for you, our feerless city prosecutor, Mr. Kaneshiro will recommend probation for this little monster. Hope the family sues the school for millions and wins.

      There’s nothing in law that allows a 9 year old accused of a felony, to be “detained” as something separate from an arrest. Assault of an educational worker is classified as second degree assault, a class C felony. If the offender was an adult, the maximum penalty would be more than one year in prison. If there is probable cause to believe that a minor committed this felony, than the minor is arrested, transported, processed and released to parents within four hours. (unless there are extreme circumstances such as involuntary mental observation)

      The parents are then faced with awaiting a Family Court date unless the Prosecutor’s Office elects not to pursue prosecution of the case or the case is deferred to a program of treatment. For a nine year old with no previous incidents, the Court would likely ask for evaluation and counseling. Possibly just requesting.

      This process is often referred to as “Getting the child into the system.” It makes it easier to provide further supports as needed. (It also helps to indemnify the State. (see the article about the teen who stabbed his classmate) It demonstrates that the State has recognized that there is a problem and is actively taking steps to address it.)

      “Detained” by HPD? What does that mean? The cops aren’t social workers, and we’re not paying them to be babysitters.

      It’s a slippery slope when you say the government can “detain” someone for no apparent reason (if you are going to say the reason is the assault, we already have a law for that, and part of the penalty is arrest).

    Wow. I remember when there were a few rules of conduct, like no running in halls, no shouting, etc. I even remember getting a ruler with them printed on it. Can you imagine the list today?

    Kid should be held in detention facility pending outcome of court appearance and since he was charge with assault of a on duty school official he should have bounded over to the adult courts for disposition of case……

      How about innocent until proven guilty. He should have his day in court and be given a chance to explain himself. Was he provoked? Off his meds? There may be extenuating circumstances. If found guilty, then I guess ResidentTax would want him in jail for the rest of his life.

        Extenuating circumstances and other issues…that’s for the court to decide…he’ll have his day in court…in the mean time he can cool his heels in detention where he’ll have time to think about his conduct….it’s called consequences…evidently something not taught by his parents.

    9 year old is 3rd grade, isn’t it. Might have a psychologist, nutritionist, family counselor, allergist look into this case. Maybe he can’t help himself and doesn’t know why he did it. Is his family beating him or going through a divorce? Anybody on drugs like ice? Pot? Not enough lunch money or allowance? Is the teacher a beach? Too much sugar or caffeine? Too much junk food. Too many computer games? Are the tests too hard for him? Didn’t give him enough time to learn ABC’s, addition, or subtraction? Shocked to learn he was born with dark-colored skin? Glad I’m not a teacher or cop.

    How big is this child and what would have happened if the teacher defended herself and whopped the kid? Oh, big law suit against the teacher and school!

      In thailand a sincere cop told me it was against the law if I had beaten up the female thief who stole my wallet. So the next time some putana tried to do the same I insulted her enough to make her mad enough to try to assault me. She got in the first punch then I countered with two Hawaiian punches right into her left cheekbones. I was forgiven, and she was jailed. With I had returned the next morning to see if she developed a baseball knot and a black eye. Once you’ve been attacked you should have the opportunity to defend yourself. So provoke them then counter. Buddha rules.

        That’s great. The lesson here, folks is that if a 9-year-old assaults someone in class, it’s best to go to a Southeast Asian country, beat up a female pickpocket and not get arrested for it.

        You’re lucky that the “female thief” didn’t have her gangster friends nearby. You would have been beaten really bad and the cops won’t do anything to them.

    Obviously Kainalu and Residenttaxpayer either raised PERFECT children or NEVER had children. Either way, what a sad statement on DOE policy, society’s litigious attitudes, but especially a teacher that CANNOT handle children with ANY compassion. I bet the teacher applies for counseling, workman’s comp, and then a permanent disability so she can collect a salary without working anymore. How exactly does a 3rd grader that’s 9 years old ASSAULT an adult ??? Male or female ??
    If the parents are dysfunctional, get the kid help. Arresting a minor serves NO POSITIVE purposes, except to give the self righteous self satisfaction.

      Now you are judging the teacher. Lets not judge anyone, let the people that can help him do their due diligence and hwish for some positive outcome. He is 9 years old!

      Waokanaka OBVIOUSLY doesn’t get sarcasm. My children aren’t perfect. Neither are my grandchildren. But they know sarcasm when they read it.

      No compassion? The teacher should have beat his a**. My son was 5′ and 95 lbs. in third grade. I would put money that he could seriously hurt most female teachers. If he attacked a teacher, I would have no issue with the yardstick coming out for self defense. That’s what we got when growing up. The edge of the yardstick across the knuckles. We learned real fast to listen and respect.

      No positive purpose? How about learning a valuable lesson on self-control and respect. You obviously have no kids. Otherwise, you would understand bad behavior without consequences is just about the worst thing you could teach your kids.

    Why is anybody surprised? They don’t let parents discipline their own kids and they don’t let the babysitters, I mean teachers, do anything either.

    This kid will be in Koolau before he is old enough to graduate from high school.
