Losing rail bidder will drop appeals

One of the losing bidders to build part of Honolulu’s planned rail line has decided not to further appeal the decision.

Sumitomo Corporation of America announced Tuesday it won’t seek a judicial review of the decision by a state hearings officer upholding the city’s denial.

The other losing bidder, Bombardier Transportation USA Inc., last week filed a lawsuit in Hawaii Circuit Court. Bombardier has also asked the Federal Transit Authority to review the disqualification of its rail proposal.

The $574 million contract went to Ansaldo Honolulu in January.

Gino Antoniello, a Sumitomo vice president, says the company still disagrees with the rulings but doesn’t want to stand in the way of the project moving forward.
