Jury finds murder of pregnant Maui woman was ‘heinous’

WAILUKU >> A jury in the murder trial of Steven Capobianco today found the killing of his pregnant ex-girlfriend was “heinous.”

Capobianco was found guilty last week of second-degree murder and second degree arson in the 2014 death of Carly “Charli” Scott.

The jury started deliberations this morning on whether the state proved beyond a reasonable doubt that the murder was “especially heinous, atrocious and cruel.”

The finding means Capobianco qualifies for a sentence of life in prison without parole. The judge set March 24 as the date for Capobianco to be sentenced.

The second phase of deliberations was for an allegation that Capobianco killed Scott in an “especially heinous, atrocious, or cruel manner.” Capobianco faces life in prison for second-degree murder.

“Killing Charli Scott was not enough for this man,” Deputy Maui Prosecuting Attorney Robert Rivera told jurors today, calling him a man without a conscience. Rivera held up Scott’s black skirt showing multiple stab wounds in the abdomen area, saying that the stabs show that Capobianco made her suffer.

Capobianco not only murdered Scott, but he made her suffer “unnecessary torture,” Rivera said.

All murders are arguably heinous, atrocious and cruel, said defense attorney Jon Apo, who suggested that Scott’s death was quick with less suffering. Unnecessary torture, Apo said, would have been one stab wound to make her suffer a long death.

The prosecution has a sympathetic jury, Apo said, noting one of the jurors is pregnant. The judge sustained Rivera’s objection to mentioning the pregnant juror.

The jury sat through about six months of testimony before beginning deliberations in the verdict phase on Dec. 1.

Capobianco didn’t testify during the first phase. He told the judge last week he also wouldn’t testify during the second phase, The Maui News reported.

      You are not a human being with rights until you are born. Until then you are simply an embryo with no legal rights according to the Supreme Court.
      This is how degenerate and immoral the liberals and progressives who control the drive by media and the government are.
      Back in the day, when morality meant something, Cabobianco could have been charged with a double murder (Charli Scott and baby).
      It is a shame, this scum cannot be hung.

          Murder in the second degree carries a MANDATORY life term with the possibility of parole in hawaii. An enhanced sentence of life without parole is possible now that the jury found the crime to be heinous.

        Wouldn’t you agree that true humanity depends on the indwelling of the human soul in what’s otherwise nothing more than protoplasm? Then please demonstrate to the world, using scientific methodology that can be verified independently, when that occurs. Is is at the moment of conception? If not, when?

        Otherwise you’re simply trying to impose your own beliefs on a system of law, something which we all know is characteristic of legal systems such as sharia which are unsuitable for Western society.

      Though I think he should have been charged for the baby’s death, that’s the decision of the Prosecuting Attorney not the jury. Can’t say they were lax. They came back with a guilty verdict for 2nd degree murder as well as 2nd degree arson and the heinous finding qualifies for an enhanced sentence. They did their job.

    He was ruled guilty, and should be punished for the crime, but I agree with the defense attorney in this case. “All murders are arguably heinous, atrocious and cruel, said defense attorney Jon Apo, who suggested that Scott’s death was quick with less suffering.”. I cannot see where what he did to her was especially “heinous”. To me, something like prolonged torture or mutilation would fit the category.

    Mr. Capobianco will have a very long time to think about what he did. I can’t imagine him concluding that it was worth it.

    Before anyone commits a crime like this, I hope they think how prison life is going to be like before doing it. How many people get away with a crime like this? Like the guy who had his wife murdered by his girlfriend. The Marine who murdered the girl in his hotel and dumps her in Waianae. Gosh!!!!!!

    Apo should be stabbed 27 times in the stomach or his loved one who is pregnant. He can find out for himself if he’s nothing but a liar or telling the truth.

      apo is just doing his job as a defense lawyer trying to present the best defense he can for his client. for all we know he may burn his suit after this case is over.
